CDPAP SFI – ALERT – DEVELOPMENTS SINCE 4/1/25

 

New DOH SFI Transition Numbers; Hearing on SFI Preliminary Injunction;  DOH Issues Interim Guidance

 

Earlier today, the NYS Department of Health (DOH) released new numbers in connection with the transition to PPL, the statewide fiscal intermediary (SFI). In short, DOH indicates that about 205k consumers have started or completed the PPL registration and about 235k personal assistants have started or completed PPL registration. More detail can be found here.

 

In addition, as shared in the Alert from earlier this week, a federal judge for the Eastern District of New York granted a temporary restraining order (TRO) in Engesser v. DOH Commissioner James McDonald, a case involving the CDPAP SFI transition. Subsequent to the TRO, much confusion resulted which led to the judge issuing a clarification. In the wake of the TRO (and clarification), DOH released updated guidance for CDPAP stakeholders. The guidance can be found here. DOH indicates that the guidance is in effect “until further notice.”

 

Lastly, today (4/4), the judge that issued the TRO in the federal case above is holding a hearing on the plaintiffs’ motion for a preliminary injunction to delay (or stop) the SFI Transition. As you may recall from earlier HCA updates, in order for a judge to grant a motion for preliminary injunction, the plaintiffs (FIs) must satisfy a three-part test revolving around (1) likelihood of success on the underlying case, (2) irreparable harm if motion is not granted, and (3) a balance of the equities favoring the plaintiff (FIs).
