CDPAP Statewide Fiscal Intermediary Update: Latest News and Developments From Mid June 2025

It was over a year ago that NYS adopted changes to CDPAP, including the move to a new single statewide fiscal intermediary (SFI). Since that time, there have been many SFI-related hearings, debates, proposals, and lawsuits along the way -- not to mention confusion and uncertainty. To lend some order and clarity to this seemingly ever-changing situation, below is a list of recent developments in connection with the NYS Department of Health’s SFI Transition process.  

Preliminary Injunction (PI): The PI issued in the case of Engesser v. DOH Commissioner James McDonald was extended until June 20, 2025. Among other things, the extended PI sets a registration deadline of June 20 for workers. More information can be found here.

DOH Guidance on the PI: On April 14, DOH issued guidance relating to employment and payment of PA’s as a result of the PI. The DOH guidance provides more information on the proper processes to be used while the PI is in effect. The DOH guidance can be found here.

US DOJ Investigation: The United States Department of Justice (DOJ) has started to investigate the SFI transition. More detail can be found here.

DOH SFI Transition Data: As of May 19, DOH indicates that (a) 209,000 CDPAP consumers have registered with PPL, (b) 75,000 CDPAP consumers transitioned to personal care services, and (c) 203,000 personal assistants have registered with PPL. A copy of the DOH press release can be found here.

CDPAP/SFI Legislation: NY Senate Bill 1189 (sponsored by Senator Gustavo Rivera) and NY Assembly Bill 2735 (sponsored by Assemblyman Al Stirpe) propose to repeal the SFI law and replace it with a FI licensure process together with various other requirements such as mandatory training and reporting. As of June 16, the bill advanced to the Finance Committee in the Senate, but remained in the Health Committee in the Assembly. A second legislative bill addressing the SFI has also received attention in the Legislature. That bill, S7954 (Rivera) / A8355 (Paulin), does not repeal the SFI but rather authorizes additional FIs. As of June 16, the bill remained in the Senate and Assembly Health Committees. The NYS Senate concluded its work for this year’s legislative session on June 13. The Assembly intends to remain in session for a few more days, perhaps until June 18.

PPL Customer Satisfaction Survey: On June 12, PPL announced the results of a survey that it conducted on over 50,000 CDPAP consumers and workers to gauge customer satisfaction. According to PPL, the survey found that the average rating for overall satisfaction was 4.04 on a scale from 1 to 5. More information can be found here.

NY SFI Transition Impacts on Workforce: According to the U.S. Bureau of Labor Statistics, at the national level the NY SFI transition contributed to an employment decline in health care and an employment gain in social assistance. More detail can be found here.

HCANYS continues to participate in regular Zoom meetings on the Statewide FI Transition with representatives of DOH, Public Partnerships, LLC (PPL), and managed care plans (including HCANYS member plans), keeping HCANYS and the membership further informed on the latest developments, and offering opportunity for input wherever possible.

HCANYS had invited PPL to participate in the HCANYS Annual Meeting on May 1 in order to meet with members to address questions and recommendations, and to share further anticipated details about the transition.  Based on the items raised at the meeting, HCANYS has since followed up numerous times with PPL and DOH, but further communications from PPL or DOH has yet to occur outside of the weekly DOH transition meetings.

HCANYS has also engaged with the Legislature, which had introduced legislation in support of the CDPAP prorgram; however, at this time, the Legislature appears ready to adjourn for the session without passage of these measures.
