New DOH Guidance on Amended Preliminary Injunction; NYS Senate Public Hearing on the SFI Transition Postponed

As reported in last week’s Situation Report, a new amended Preliminary Injunction (PI) was issued by the judge in the Engesser v. DOH Commissioner James McDonald SFI litigation case. In the wake of the amended PI, the NYS Department of Health (DOH) released new guidance, which takes effect immediately.

In the interim, the NYS Senate announced that a public hearing on the SFI transition initially scheduled for July 9, 2025 has been postponed. The hearing, to be conducted by the Senate Committee on Health and Senate Committee on Investigations & Government Operations, planned to examine the CDPAP transition to a single statewide fiscal intermediary (Public Partnerships LLC), and the challenges experienced by enrollees, workers, and stakeholders. No alternate date has been made available yet for this hearing.
