CDPAP Statewide Fiscal Intermediary Update: Latest Developments

Since last week’s update on the CDPAP statewide fiscal intermediary (SFI) transition, there have been two additional developments that could be significant for the ongoing implementation of the transition and operation of the program.
First, in the NYS Legislature, there will be a public hearing to examine the SFI transition on July 9 in New York City. Immediately after the 2025 legislative session concluded in Albany, the NYS Senate announced the scheduling of this hearing. Led by Senator Gustavo Rivera (Chair, NYS Senate Health Committee) and Senator James Skoufis (Chair, NYS Senate Investigations and Government Operations Committee), this hearing will focus on the challenges with the SFI transition as experienced by enrollees, workers, and stakeholders. The stated goal of the hearing is to ensure that the voices of those impacted by this transition are heard. More information on this potentially important hearing can be found here.
In the meantime, activity in connection with the implementation of the SFI transition continues in the courtroom as well. As indicated in earlier HCANYS communications regarding SFI litigation, a federal judge in the SFI case of Engesser v. DOH Commissioner James McDonald issued a Preliminary Injunction (PI) in favor of the Plaintiffs. The PI permits current CDPAP consumers to use their existing fiscal intermediary in certain limited circumstances, and it also provides more time for consumers and personal assistants to register with the SFI (PPL). The PI was originally scheduled to expire on June 6, but was later extended by the judge to June 20. Late last week, the federal judge extended the PI again - this time until July 1. Further, in light of the most recent PI extension, DOH has indicated that a settlement agreement is being worked on and could be finalized prior the new July 1 expiration date of the Preliminary Injunction.
